The Founders straight up rejected a lot of power judges now have including the power to declare something to be constitutional or not. How it's supposed to work-

Executive Branch does something it isn't able to - Legislative Branch can either override the Executive Branch with super majority vote or at the extreme impeach the president if he doesn't stop doing whatever it is he is doing.

Legislative Branch does things it isn't able to do - President can veto any bill at any time.

Legislative Branch or Executive Branch tries to do the duty or job of the other branch - Judicial Branch tells whichever side to stop doing that and to stay in their own lane.

No more, no less.

Too many judges are scared to give sentences that might be seen as "cruel and unusual punishment". Let me tell you this: if someone you care about gets murdered, you'll want the murderer to pay, and you will not spend a picosecond hoping that the murderer's punishment will not be "cruel and unusual".
