Not sure if you know how renting apartments work, but non-tenants do not pay rent to landlords they don't have yet, so they can't refuse a prospective tenant because they weren't paying rent yet for apartment they never had..

No. He was sued because he had instructed his staff to not rent to black or brown people. What the DOJ was able to show is that a black man or woman would ask about an open apartment that had been advertised. They would be told it was full or if an application was taken an N or a C would be written on the application. They would be denied the apartment.

Then a white woman or man would inquire about that apartment shortly after, and they would be offered the apartment.
