But probably why he wasn't arrested after being interviewed by the FBI is that his words to storm the capital happened on Jan 5th. And he didn't enter the capital building.

Inciting a riot is a crime. Unless it wasn’t a riot? Ok we agree.

Okay. So, we know Epps was on BLM Plaza telling people to storm the capital building on Jan 5th. That's a fact. He's on camera.

Federal law defines a riot as a public disturbance involving three or more persons engaging in acts of violence with a clear and present danger of damage to property or injury to people. The law includes threats of violence if those involved have the ability to immediately act on the threat.

Now, if you were on a jury, and someone was being charged with inciting a riot BUT the things they said were said the day before in a location a mile away from where the riot happened.

Because remember the "ability to immediately act" is a part of the law.

Would you convict someone of inciting a riot 24 hours later? I know that I would not. It's too far in time. And there's no way to know of any of the people who heard Epps were at the actual riot that happened later.

It's not beyond a reasonable doubt.

So that's probably why Epps wasn't charged. And not because he's an agent of the FbI.

He was there at the Capitol at a breach point doing it on the day of the riot. It’s on tape as well. He was encouraging it then as well. People at the same place that did less than him are in jail right now. Everyone around him was investigated and arrested or charged. That inconsistency is unexplained. Why?
