An eyewitness statement or affidavit stating he saw the defendant pull the trigger would be testaments to the prosecutors case. Now let's say, we have the same scenario, but the defendant can supply counter evidence to disprove the eyewitness, in this case video footage from a restaurant he was in at the time of the shooting. Here the affidavit would be worthless and evidence of nothing.

Since this trial was dropped there was a chance for Discovery, so all there is this affidavit which is the only piece of evidence. Hence it's just a statement.
