never really got onboard with the whole "hate speech" train.saw too much wiggle room for it to be exploited.

but I am also a free speech absolutist.

I usually disagree with you, but on this - we're on the same page. I feel that people who filter their speech for the comfort of others do less communicating than the rest of us - who just speak.

what specific slang, jargon or rhetoric is responsible for inciting violence?
was it the word that was the matchpoint?
or was it the political, cultural and socioeconomic atmosphere that lent itself vulnerable to being blown up by fiery words? passionate rhetoric?

when we target the words and ignore the underlying pressure cooker that creates the environment that lends itself vulnerable to inciting language.

we become the thought police.

when you start to restrict one of the most powerful rights we have under the guise of "protecting the marginalized and vulnerable"
you open the door for massive abuse by those in power, and can affect not only social interactions but can infect vital institutions we all rely on,and already HAVE affected those institutions.

the best antiseptic is to drag those f**ked up,fringe f**kwits into the light.
I finally got purgey to admit..openly..that he is a neo-Nazi.

I could have never done that if his speech had been hampered.
because if you restrict speech,
you aren't restricting Nazis from thinking like a fascist.
you aren't stopping a racist from thinking like a racist.
you aren't swinging the thoughts of a homophobe,or an islamaphobe.

all you have done is pushed that f**ked up thinking into the underground.where they gather like roaches...
and spread like a virus.
just look at how the neo-nazis in America have had to create their own dog-whistle language to communicate!
and they have f**king grown in size!
all because some well intentioned, but short sighted, moralizing lib decided that "speech can be hateful",and should be made illegal.

words are an amorphous and fluid means to express complex feelings, thoughts and visions and are entirely inadequate at times.
to attempt to legislate words is an exercise in futility, and hands far too much power to the state to impose restrictive guidelines, based on an incredibly flimsy dialectic, and can easily be exploited for nefarious means.

naw man...
I want that shit up front and out in the open.
so I can ridicule them relentlessly.
the "call-out culture" needs to be called out.

because good intentions do not always produce good results.
and can,and usually are, exploited by the powerful eventually.

and we all are the lesser for it.

I appreciate your cogent, lengthy, and well thought-out reply.

However, I disagree from you somewhat. I think you are overlooking the value of placing social prohibitions against hate speech. If the hateful language is ostracized, then by extension the ideas are, too. It then carries a social cost to express Neo-Nazi views.

That is all I and I think most liberals are saying. We don’t want to criminalize it, just heavily ostracize it.

Rather telling when all that today's kidz can do is BRAG about being the first to jump on the latest Tumblr recycled line because they can't think for themselves.
reply

It was a funny little line the first hundred times I saw it, but it only applies to one group of people who are typing behind an anonymous identity online. So these idiots were calling everybody "boomer" which makes it a non-nonsensical term; early retirement, ironically. "Whatever", says the Gen "Xer". That one still gets mileage, even today.
1 up, 4d
I used to joke after Tweeter became a thing that they were gonna come out with "Bits" that would be like 3 words then eventually "Bit" which would be just 1. Then finally the clueless generation would be communicating solely with emojis.
Seeing all these posts of just "Boomer" makes it seem like I had given these unimaginative dolts too much credit.

"I jumped on that bandwagon when it still cool" said no one with an actual brain ever.

There is actually an objective definition of hate speech: speech that attacks others for their personal identity characteristics (e.g. race, sex, sexuality, disability). It's wrong for many reasons, the main one being that it assaults their humanity, and another one being that it is simply not productive or conducive to rational debate.

You shouldn't be thrown in jail for using hate speech, but you should be scolded.

Leftists who try to broaden that definition of hate speech in an effort to shut down conservative debate on other topics are wrong. However -- I think that far fewer people on the Left have that attitude than this meme implies. They are loud, but they are few.

Very good point, but the problem is that, no matter what group you're talking about, it's usually the loudest voices that define public perception of those groups the most.

We have the ability to target individuals who subscribe to ideologies or organizations that terrorize people. Leveling their rhetoric to increase punishment of a crime seems redundant. Censoring rhetoric is moronic and opens the door to willful, stubborn ignorance.
reply
1 up, 6d,
1 reply
If there's an underlying crime (like a battery or a murder), then I think a hateful motive can be used as a sentencing-plus factor.

But merely holding or even expressing those attitudes, while wrong, shouldn't be a crime.
reply
1 up, 5d,
1 reply
But why? We already have laws against battery or murder. Why should we charge someone for having a different belief? Even if that belief is cruel and wrong, it is not illegal to hold them. It is illegal to act on them but I see no point in giving unfair sentences for people committing the same crime. Not only this, the crime may not even have any relevance to that person's beliefs and could be argued as just another form of persecution. And by then, we start down a very rocky path when we allow the government to judge our speech, our texts, our histories just to increase the punishment of something that is already illegal.
reply
1 up, 5d,
1 reply
Motives are used to adjust criminal sentences all the time, up or down. Inadvertently running someone over on a dark and rainy night is judged differently than a premeditated murder.

So, if it can be proven that a crime was motivated by hateful intent (which it should be noted, must be proven according to the same rigorous standards of proof as any other element of a crime) then Defendants should be judged more harshly. We as a society have an interest in punishing hateful motives as they not only lead to murder but also more typically lead to mass murders, as in the case of Dylann Roof. So, I think it's relevant and not a slippery slope if confined to the situations I described.
reply
1 up, 5d
Yes, but you're ignoring my point. It is not a crime to hold different beliefs. Yet, by prescribing beliefs to a crime causes these beliefs to become illegal. I'm not entirely convinced that punishing those with hateful motives does any good at all.

If I may, I'm not a fan of this country's form of rehabilitation. A laughable word when it comes to US Prisons. Sentencing people with these kinds of beliefs to keep them in prison longer only exposes more people with petty crimes to this ideology. Fueling that hatred and increasing the chances of spreading those beliefs. Essentially, by making "hate" illegal, you allow it to grow. And when you over-exaggerate any simple crime into accusations of something more heinous, you essentially criminalize free thought and speech.
