Im not saying I agree, but the reasoning is that wearing a Trump hat is something you choose, while being gay isnt. Your attire isnt protected under the constitution, but who you are is. The Civil Rights Act of 1964 was the nation's premier civil rights legislation. The Act outlawed discrimination on the basis of race, color, religion, sex, or national origin, required equal access to public places and employment, and enforced desegregation of schools and the right to vote. No discrimination based on sex. Whether that counts sexual orientation i do not know.

But speech is protected.
In one instance you are forbidding speech on you property, by not allowing them to wear the hat. I'm okay with that, it is private property after all, and it's not really that hard to remove the hat for the duration of your dinner. And if you object to what the business is doing, boycott it and don't give it your business.
However, the second situation is forcing speech. Let's not pretend wedding cakes are simply pick cake 107j out of a catalogue. They are designed (an artistic endeavour) specific to the occasion. You are forcing an artist (and art IS speech) to say through their work that they support the union of two people of the same sex. This is different than demanding they merely remain quiet on the matter. I also can't understand why any couple would choose to give their business to them (unless it is about forcing the participation of the unwilling). They should want to boycott the business.

Ah that makes sense. It is forcing the baker to express support for the marriage. I support the Supreme Court ruling of the cake case. The court specifically said it would not set a precedent for it cake case. I think the business should also have power to ban the hats too, so we are in agreement.

Civil rights laws are very specific about protections of our rights based on being a minority versus just being or wearing an asshat.
