Your meme hits the nail on the head in a way — the state of Texas sued other states directly as a means of getting this case in front of the Supreme Court directly, bypassing lower courts, since SCOTUS has original jurisdiction over interstate suits.
However, that’s a jurisdictional question only and has nothing to do with the law or the facts of the case.
As others have alluded to, I think SCOTUS will decline the suit based on lack of standing. There’s no precedent I’m aware of for states suing other states over how to run their elections. Typically, they are very not eager to involve themselves in political questions that are this explosive.
And again: this is not a 2000-like election scenario in which 500 votes in 1 state decided the whole election. It’s a 2016-like election scenario: same exact Electoral College margin of victory (306), and a similar or sometimes greater popular vote margin than Trump ‘16 in the swing states Biden won in ‘20.
I believe SCOTUS will decline the suit with a very short 1 or 2 line order, but I am hopeful that they let it rip on this Texas AG. Maybe one of the 3 liberal justices will pen a detailed concurrence of the denial, explaining the holes in the suit’s logic, but that won’t be as effective as a unified front.
What we really need is for ACB to put on her big girl panties and swat it down with undeniable force and even sanctions and disbarment for the Texas AG so that MAGA country gets the message that stacking courts with their favorite judges doesn’t mean they get a free pass to ignore the law and file frivolous lawsuits as another means of conducting politics.
MAGA country should have already gotten that message with all the lower-court suits smacked down by Republican and even Trump-appointed judges, but what can ya do.
