Your meme hits the nail on the head in a way — the state of Texas sued other states directly as a means of getting this case in front of the Supreme Court directly, bypassing lower courts, since SCOTUS has original jurisdiction over interstate suits.

However, that’s a jurisdictional question only and has nothing to do with the law or the facts of the case.

As others have alluded to, I think SCOTUS will decline the suit based on lack of standing. There’s no precedent I’m aware of for states suing other states over how to run their elections. Typically, they are very not eager to involve themselves in political questions that are this explosive.

And again: this is not a 2000-like election scenario in which 500 votes in 1 state decided the whole election. It’s a 2016-like election scenario: same exact Electoral College margin of victory (306), and a similar or sometimes greater popular vote margin than Trump ‘16 in the swing states Biden won in ‘20.

I believe SCOTUS will decline the suit with a very short 1 or 2 line order, but I am hopeful that they let it rip on this Texas AG. Maybe one of the 3 liberal justices will pen a detailed concurrence of the denial, explaining the holes in the suit’s logic, but that won’t be as effective as a unified front.

What we really need is for ACB to put on her big girl panties and swat it down with undeniable force and even sanctions and disbarment for the Texas AG so that MAGA country gets the message that stacking courts with their favorite judges doesn’t mean they get a free pass to ignore the law and file frivolous lawsuits as another means of conducting politics.

MAGA country should have already gotten that message with all the lower-court suits smacked down by Republican and even Trump-appointed judges, but what can ya do.

If a state is not getting it's fair say in the election because of suspected fraud, they have the right to take it to court. What's the point of being in the Union if your vote doesn't really matter?

Indeed. All of the other sycophantic Republican state AG's signed onto it. About 1/3 of states total. Most of which are small, rural, and as a consequence deeply Republican.

Many of those AG's have been denounced by other Republicans in their states (and GOP Senators) for doing so.

Republican votes matter; in fact, they matter much more than Democratic votes on average thanks to disproportionate representation in the Senate, rampantly gerrymandered House districts, and of course the Electoral College which can grant victory to a GOP candidate who loses by 3 million popular votes and even make a GOP candidate who loses by 7+ million votes think he's somehow still entitled to win.

Those structural benefits to the GOP leave them with a lot more power in our system than they should have if we were a fully representative democracy.

If losing one presidential election is all your patriotism depends upon, then okay. Leave.

Just don't fire on Fort Sumter on your way out.

You have to prove that the votes were unconstitutional and if the Electors say there is not proof.......you are kind of screwed. That is how law works. You prove it with facts or it gets dropped like a hot potato. It is REALLY HARD to prove because of the way it all works. If the people providing the proof took the tallies and therefore the proof cannot be proven tainted then ......you lose.

Yeah, they're making a claim but offer 0 evidence.

Let me repeat that: Texas lists 0 evidence of fraud.

When you make a claim in court, you have to bring evidence. You have to list the evidence in the suit.

They are bringing ZERO AMOUNTS OF EVIDENCE.

This won't be taken up by the court.

This is political theater so the can squeeze more money out of MAGA country.

You should go read the transcripts of the court cases. Because the judges ask for the evidence and trump's lawyers say they have none.

I am disappointed, and would disagree with the majority opinion, but I'm glad to see that Justice Alito and Justice Thomas dissented.
It's not the end of the line though. This came out of nowhere, and if it leaves just that way, we still have the same lawsuits we had before.

Alito and Thomas dissented in that they would have allowed the case to be filed, but they said they would have decided the same way.

Texas has no standing.

This is the end of the line.

This is why they call the Supreme Court the Supreme Court. There are no more places to go with any lawsuits.

It's over.

There was no voter fraud.

Biden won.

All the states certified their elections before the safe harbor day. Federal law requires Congress to accept those elections.

Paul Smith, a professor and election law expert at Georgetown University's law school, said Texas did not have a legitimate basis for the suit.
"There is no possible way that the state of Texas has standing to complain about how other states counted the votes and how they are about to cast their electoral votes," Smith said.

Incorrect. If they did it by violating their own state laws, then they do have standing. Its called rule of law or sedition in legal terms.

Even though states violated their own laws, Texas may not have grounds to sue. The law is specific about who has standing. Someone has standing to sue, but it just might not be Texas.

On a moral level, I agree. The courts, however, may not. We'll see what the courts determine. Unfortunately, that's all most of us can really do, is wait and see.

Well in the Texas case its actually only claiming that the other states did not follow the constitution and caused the election to be swayed to Biden. They are alleging that if the constitution was followed Trump would have won. In this case its pretty clear that the SCOTUS will have to at least hold a hearing on it and make a ruling.

Without actual evidence to do so, just as those lawsuits in the individual states have already dismissed, Texas' lawsuit will also be dismissed. In either case, it no longer matters. All states have now formally certified their election results.

But it's not over. Though the chance to overturn the election is even more unlikely now, there are a few more avenues that Trump and his supporters can still pursue.

Ultimately, they will all be a waste of time.

Just like Trump's impeachment.

Today's politicians no longer care about winning their cases but rather using them as a way to add propaganda. This has being going on for some time by Republicans. The end results are still beneficial without the win.

It's a way to salvage Trump's political career if his base thinks the election was stolen from him rather than the narrative that he was simply just another unpopular disgraced President the likes of Clinton and Nixon.

Nope. Texas is claiming that the other states failed to follow constitutional law and their participation is no longer valid. The Supreme Court can rule that the states must redo the election, or that congress decides in which case Trump wins hands down.
