To be clear:
1. Heterosexual or LGQwerty will still do time for the crime based on the law.
2. In both cases, Herero or LGBTwhtevs are put on the SOR at the discretion of a judge, and that being due to extenuating circumstances that arise often enough to warrant such a judge's discretion, e.g. youth lying about their age to older individuals...cause we all know that happens. When I was in middle school some girls thought 25 to 30 year old men were trophies and would lie about their age to get one. That is just one of the reasons to keep someone off who, the judge believes, was deceived.

A possible out is still and out. And I don't see how they could avoid being put on the SOR if they still get jail time for it, maybe there's something I'm missing there.

True, it doesn't guarantee keeping them off the SOR, but it does open up the possibility that people who should be put on the SOR aren't.
