This is possibly why they're forcing the "see, they're still totes married!" narrative - she knows all the details, but if she divorced him now, spousal privilege goes away.
It would be great to be a fly on the wall and to watch those two as they are forced to stay together for political gain. Living in a house with someone you hate will take a toil.
