Back in 2016, when President Obama nominated Judge Garland for the vacant scotus seat, Justice Ginsberg said that the president is the president for four years, and there's nothing in the Constitution that said a nomination should wait until after an election.
Besides, it was a dying wish. Not a dying demand to follow a law. I'm not saying this is the case with her, but if dying wishes were always granted in politics, because doing so would be "just nice", then there are plenty of people who make dying wishes for things outside the norm, that have a regular process. And they would be doing it for one reason; to get their way when they wouldn't otherwise be able to.
Besides, this is politics. Both sides have shown that playing nice only accomplishes one thing; losing.
Sorry chimmels, but this whole being respectful and being nice narrative is beyond naive, imo.
