Seeking asylum is entirely legal. They're showing up at the ports of entry. They are attempting to enter the country legally. And they are still being separated.

How could you know if they had or hadn't applied previously at another country? And if they had, how do you know whether or not it had been denied?

Just take a moment and think about the logistics it would take to confirm that "apply at the first country you reach" part.

And then whose rule is that? How do they enforce that rule? 8 U.S. Code § 1158. Asylum (the official law that deals with asylum) says nothing about "must not have applied for asylum at any other country" at all.

In fact, 8 U.S. Code § 1158 says if they are denied asylum here we are expressly forbidden from exporting them back to their country of origin. They must be sent to a safe 3rd country.

So now they're in a 3rd country and...what? They can't apply for asylum there? Do they have to like swim out into the ocean and just float there?

And how do you know they didn't apply for asylum at every country and were denied? Then allowed passage through the country to get to the US?

Ethics? What about violating a country's laws? That's ethically bad too. The US has an asylum policy for those that need it - and it does not include FIRST violating U.S. law. Taking your kids with you to go break Federal law is a recipe for more problems, not less.

What you're not understanding is that a lot of those children weren't even blood related to whom they were removed from. Because the policies were relaxed when children are involved, people would TAKE CHILDREN to help them get a "pass" at the gate. In fact, many of these children are 1) kidnapped 2) are part of human trafficking 3) being sexually abused. Stop believing everything CNN tells you. The taking away of the children was for the PROTECTION of the children from traffickers, not as a deterrent that you are suggesting.

If a legal citizen commits a crime, WHILE HIS/HER CHILD IS WITH HIM, then in effect - yes. The child is initially taken to CPS for protection, and may, or may not, be released to another family member depending on circumstances. In any event, the child IS in the custody of the state at that point. One of the best ways to avoid this from ever happening is don't commit crimes and bring your kids with you. Better yet, don't commit crimes period. That's even better.
