The second they overstay their visa date, they are here in America illegally. Period. They are thusly breaking the law and should be dealt with as such. And that goes for every person who overstays their visa from every country around the world.

So do we set up check points at every state to verify passports like they do in other countries? The only place this is checked at is the DMV, run in with the law, employment, and air travel. Other than that very little oversight.

Yes, a misdemeanor is a crime, albeit a minor crime. Petty theft, wreckless driving, bodily assault, prostitution, etc. All of those are crimes (maybe not in California) that are considered a misdemeanor.
