1) Biden returned the documents.
2) That's why he wasn't charged (also, he's a sitting President, and according to a Nixon era memo, sitting President's can't be charged. I think it's BS, but it's the rule still in place).
3) Trump has been charged for the documents he didn't return.

Because this recording is specifically mentioned in the indictment.

I can be wrong about this, but I don't think I would include an audio tape of him talking about specific confidential records and not charge him for those specific records.
