If he didn't want to be indicted, maybe he shouldn't have stolen classified documents and obstructed their return.

How can the President "steal classified documents?" The worst any President could do is mishandle them like keeping them in his garage. I don't think anyone has accused Trump of "stealing documents."

Trump ceased being President of the United States at a specific date and time.

He still had boxes and boxes and boxes of documents at his home in Florida when he ceased to be President.

He was told he had to return them as they were property of the US Government, and not his personal records.

He refused. Not only did he refuse, but he deliberately instructed employees to move the boxes around so his lawyers wouldn't find them (and thus report back to NARA that there were none). When he did give some back, he personally sorted through them to make sure some weren't given back.
