5 U.S.C. § 3331
An individual, except the President, elected or appointed to an office of honor or profit in the civil service or uniformed services, shall take the following oath: “I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.” This section does not affect other oaths required by law.
It literally says the oath is sworn to:
“support and defend the Constitution of the United States…”
Not the president.
Not Congress.
The Constitution.
The president gains authority comes from Article II, Section 2 of the U.S. Constitution:
“The President shall be Commander in Chief of the Army and Navy of the United States…”
This means the president gives military orders - but only within constitutional and lawful bounds.
Article VI, Clause 2:
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
“This Constitution… shall be the supreme Law of the Land…”
Then there's this:
Article 90 (10 U.S.C. § 890) — Willful disobedience of a lawful order from a superior officer
