Actually if you go back to the original ruling they only said it was legal in Roes case as it was rape, they never gave it a blanket go ahead, the states just assumed.

It is a double edged sword. One edge bans abortion, the other legalizes it.

SCOTUS was never meant to legislate,
only interpret whether a law, or the actions under said law,
meets constitutional muster.

SCOTUS was being an Activist when it enacted Roe... then, almost 5 decades later
SCOTUS went back to being itself when it overturned that activism & sent it back to the states.
