Yes, probable cause ie usually needed, and cops do not need it in some circumstances: say they see something illegal in plain view, and as you said, weaving guns around, although I can't for the life of me remember the term, I don't think it was "public danger" although I'll find it

It is difficult in some cases to get to the very heart of the matter.
But in this case, it is not hard at all.
The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our
constitutional order.

This should be shocking not only to judges, but to the intuitive sense of liberty that
Americans far removed from courthouses still hold dear.

Perhaps, but perhaps not.
Regardless, he is still entitled to due process. If the government
is confident of its position, it should be assured that position will prevail in proceedings to
terminate the withholding of removal order. See 8 C.F.R. § 208.24(f) (requiring that the
government prove “by a preponderance of evidence” that the alien is no longer entitled to a withholding of removal).
Moreover, the government has conceded that Abrego Garcia was wrongly or “mistakenly” deported. Why then should it not make what was wrong, right?
You don't seem to understand. A law passed by congress does not override the constitution. The only reason a cop can arrest you without a warrant is because they consider you a public danger.
In the past you could make the argument that things were too slow so they might arrest you and hold you for 24 hours.
That excuse no longer flies as they can video the evidence message it to a judge and the judge can sign a warrant all under a minute. If you get arrested without a warrant or public danger you can criminaly prosecute the cop and any judge that doesn't dismiss the case in a constitutional court.
