Yep - first rule is "Treat every weapon as if it is loaded"
Second rule is "Someone hands you a weapon, you check to see what state it's in." In this case, that was Baldwin's responsibility to check, no matter what someone told him about what condition it was in.
Reminds me of a time when I was visiting family at Christmas and my nephew wanted to show me the deer rifle that he got for Christmas. He opened the case and handed it to me. I immediately checked the magazine well and then racked the bolt back and checked the chamber. It was just automatic for me but my nephew's dad was all "Look at that, would ya, that's Marine Corps training right there!" (I had been in about 15 years at that point.)
