In all fairness, if you listen to about another minute of the speech he clarifies what he means. What he was saying is that the people are the government. While still wrong it is much closer to the truth. The government does derive its powers from the consent of the governed but the government is and never will be the people. It maybe filled with people but as an entity of its own it is not the people.

Biden only has a 1st graders understanding of the Constitution, the Declaration of Independence and the founding of this nation. He should really stay away from trying to sound Constitutionally literate. He is just not.
