There is nothing in the Constitution, even implied, that says when and how Supreme Court vacancies have to be filled, or even the number of Justices. President Trump tweeting about the press is nothing compared to the Obama Administration jailing a reporter and planting national secrets on anothers computer.
The president “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint . . . Judges of the supreme Court, and all other Officers of the United States.”
That's what the constitution says. What is not clear is what should happen if the Senate waives it's right or duty to advise and consent. Could have Obama simply appointed Garland?

No, it's not an actual strawman In my state and as few other places gun ownership was virtually banned in violation of the 2nd amendment. In time it got overturned by the right was ignored. Also several colleges have been found to be in violation of the 1st amendment by illegally restricting freedom of speech.
Just because you personally have not seen this type is illegal restriction of right doesn't mean it doesn't exist, as such you should do some basic research for commenting on it.
