Dude I make it simple for you:

If you can not prove war/armed conflict than it is not a war crime. For a war crime to exist there has to be war.

The Rules of War not only cover what not to do, but also the exeptions to the rule. Example: If an occupied force loses Soldiers to Partisan Warfare they are allowed to kill 20 civillians per soilder in Retaliation.

You make the claim of deportation over 70 years ago, good luck proving that it was deportation in the first place. The claims of the children and childrens children are not holding up in a martial court.
