Could he try to make that happen? I think he's expressing an opinion that is highly controversial.
Any attempt to try to pass such a program would be dead in the water before even getting to the floor(s) of Congress to pass. And then, it would be litigated to death anyways, by any means, in the courts.

Why do it and why now?

First, it's an indication that they don't think they can steal it. Second, it's to set up not certifying the election because Trump is a "threat" to national security because he worked with Russia to steal it.

Because Roe vs. Wade should never have been decided at the federal level. The federal government simply doesn't have jurisdiction unless you are doing abortions while traveling across state lines in an ambulance or something. They'll strike it down because the 9th and 10th amendments.
