Tennessee classifies prostitution as a misdemeanor, but someone who tests positive for HIV is charged with violent sexual assault, a felony.

They can't control whether or not they have HIV. So, charging them with a felony for the same act another prostitute without HIV is charged for a misdemeanor is discrimination.

Either they should both be charged with the misdemeanor or a felony. With the Rule of Law, you have to treat everyone the same.

I am of the opinion sex work should be decriminalized and treated like any other profession.

Of course, if you're worried about getting HIV from a prostitute there's an easy fix; don't have sex with prostitutes.

For it to be discrimination there were have to be 2 people who committed murder. The state of Tennessee classifies that murder as a misdemeanor. BUT one of them is wheelchair bound, and that murder is escalated to a felony charge simply because the murderer is in a wheelchair.

Same crime, but they're treated different because of something about them they can't control.

The government can compel your employer to fire you for not getting vaccinated in the name of public safety yet forces Tennessee to allow hiv positive hookers to work. If I, as a white person, kills a pocket a jury can sentence me to more jail time because it's a hate crime. Yet a black man who kills another black man in a much more horrendous fashion would not face the same sentence enhancement. Stopping crime should be the end result, not worrying about hurt feelings

The DoJ is suing to make sure that everyone who commits the same crime gets the same sentencing.

The DoJ isn't suing the state in order to force HIV positive sex workers to work. It's suing the state to make sure everyone is treated the same.

So that means you are against prosecutors adding additional charges where race of the victim or perpetrator is concerned. Wouldn't that be consistent with your argument?
