Tennessee classifies prostitution as a misdemeanor, but someone who tests positive for HIV is charged with violent sexual assault, a felony.
They can't control whether or not they have HIV. So, charging them with a felony for the same act another prostitute without HIV is charged for a misdemeanor is discrimination.
Either they should both be charged with the misdemeanor or a felony. With the Rule of Law, you have to treat everyone the same.
I am of the opinion sex work should be decriminalized and treated like any other profession.
Of course, if you're worried about getting HIV from a prostitute there's an easy fix; don't have sex with prostitutes.
