Here is how things actually ok

If a woman feels she was sexually assaulted she calls 911 and files a complaint. They then investigate to learn of any factual evidence and witnesses. If they can find "PROBABLE CAUSE" a arrest can be made a Prosecutor can decide weather or not charges will be filed

then it goes into court. Innocent until proven guilty of the supposed crime.
