Race may play a role in it, but also economic class as well, as poorer people in general tend to be treated not as well as more well off sorts by police. The ability to hire better legal help is a great deterent.
Regardless, there is a history of treatment beyond unfair. There are many people alive today who remember when lynching was legal. From their perspective, this isn't all that far removed from that, only with a badge to make it permissable.
