If the baby is born here, it's a citizen. The Constitution says so. Here, I'll quote it for you, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

See? born or naturalized in the United States.

That's why you won't answer the question about what happens to undocumented immigrant who gets arrested and found guilty of a crime.

It means they're subject to the jurisdiction of the United States.

Now, there is a type of person that is not subject to the jurisdiction of the United States. And that's a diplomat.

That's why the language is so weirdly specific.

Diplomats have diplomatic immunity. You've probably seen it in movies. They can't be arrested for a crime. Why? Because they are not subject to the jurisdiction of the United States. And if they have a child while here in the US, that kid is NOT a citizen of the US.

Because they're not subject to the jurisdiction of the United States.

It means they are subject to the laws of the United States. The Jurisdiction. You know, the power to make legal decisions and judgements. Like the ability to send someone to prison. Or set them free.

Did you know they debated over the meaning of the amendment? Did you know they wrote down that debate?

Yeah, they did. And we know exactly what they intended; anyone born here is a citizen.

It means you are subject to the jurisdiction of Japan while within its borders. Do you think you can just go to another country, commit a bunch of crimes, and have nothing happen to you?

He did. In a letter to Madison in 1786. (https://founders.archives.gov/documents/Jefferson/01-09-02-0221)

But – and this will shock you – the lone sentence is wildly out of context. The context that quote is plucked from is Jefferson is arguing that Americans can't be subjects of the British Crown because they're citizen's of the United States AND the King signed a treaty acknowledging that they were separate sovereign nations.

Here's the quote: I know there is an opinion of Ld. Coke’s in Calvin’s case that if England and Scotland should in a course of descent pass to separate kings, those born under the same sovereign during the union would remain natural subjects and not aliens. Common sense urges strong considerations against this, e.g. natural subjects owe allegiance. But we owe none—. Aliens are the subjects of a foreign power. We are subjects of a foreign power—. The king by the treaty acknoleges our independance; how then can we remain natural subjects—. The king’s power is by the constitution competent to the making peace, war and treaties.


So, in the end, Jefferson didn't mean it the way ChrisMahar means it.
