Nope; that's *story* that people with anti-immigration political agendas want you to believe, likely hope you won't question, won't fact-check. Why? Because, per 8 U.S.C. § 1158, there's no legal obligation whatsoever to cross the border at a Customs checkpoint/official entry point.

Additionally, in a realistic sense, if they crossed unobserved it doesn't matter how long they've been in country -if they don't run afoul of the judicial system they may enter a claim for asylum whenever they feel like it and the burden is on the government to prove they've been this side of the border longer than a year.

Because the government has a bad habit of passing laws and then passing more laws that negate the first laws. Or passing a first law and then passing more laws that are effectively rendered void by the first law. Chalk it up to headless chicken factor.

That's kind of the size of it, ngl. Look at it this way: United States Code is 54,000 pages long and the odds of anyone in Congress or the White House being up to speed on all of it are very low. So technical loopholes like § 1158 happen.

8 U.S. Code § 1158 - Asylum

(a)Authority to apply for asylum
(1)In general
Any alien who is physically present in the United States or who arrives in the United States (>>>whether or not at a designated port of arrival<<< and including an alien who is brought to the United States after having been interdicted in international or United States waters), >>>irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.<<<

(2)Exceptions
(A)Safe third country
Paragraph (1) shall not apply to an alien if the Attorney General determines that the alien may be removed, pursuant to a bilateral or multilateral agreement, to a country (other than the country of the alien’s nationality or, in the case of an alien having no nationality, the country of the alien’s last habitual residence) in which the alien’s life or freedom would not be threatened on account of race, religion, nationality, membership in a particular social group, or political opinion, and where the alien would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection, unless the Attorney General finds that it is in the public interest for the alien to receive asylum in the United States.

Nope. So long as 8 U.S.C. § 1158 is on the books, crossing the border away from an official entry point isn't a criminal act. Some argument could be made for culpability given that it's classified as a misdemeanor; but that's where § 1158 comes into play, quashes any potential for a misdemeanor charge upon request for political asylum.

Yes. And 8 U.S.C. § 1158's leeway operates as a blanket, effectively eliminates permission & visa requirements for anyone crossing into the U.S. at any location with a grace period of 1 year in which to file an asylum claim. See how that works?
