Depends. If it's an employee then it's up to the owner to decide. It it's the owner deciding not to bake the cake then that's the end of it; at least it is according to court rulings.

Wrong interpretation of events. The cake was for a gay wedding. The courts ruled the baker was within his religious rights to not PARTICIPATE in something against his religious views. He had no quarrel with baking anything else for a gay person.
