The draft was not ruled unconstitutional. In 1981 a court declared that a “male only” draft was unconstitutional. The military had a male only draft because they did not allow women to serve in combat roles. Since that time women are now eligible to serve in combat roles. The judge’s ruling did not affect the selective service registration.
