I am not sure what powers the Executive Branch acting alone could wield in this case, but Congress + the President acting together are capable of “compelling” states to establish minimum baselines.

The example that comes to mind is the minimum drinking age. Establishing a drinking age is a state prerogative, but as a practical matter, it’s age 21 nationwide, because all states want access to these highway funds.

An analogy in this case could be Medicare and/or Medicaid funding. Want to continue receiving healthcare funds for your state? Then continue to allow women access to the same health and reproductive choices they’ve enjoyed for the past 50 years.

Will Democrats actually do it? I doubt it. But this is one form that a robust federal response to constitutional rights erosion could take.
