I'm no fan of these clowns by any means, BUT I do think it's worth mentioning that the entire point of the Fifth Amendment is that it isn't and shouldn't be considered to be incriminating in and of itself to take this Constitutional right.

Because that's exactly the point: you're choosing not to incriminate yourself. And the only way that makes any sense at all is if we all agree that silence is not an act of incrimination.

Innocent until proven guilty: the burden of proof is on your accuser, not the accused. Silence puts the obligation on the prosecution to prove a crime. This is a critical component of the Miranda rights and arguably one of the main reasons the United States was such a pioneer in modern jurisprudence.

AKA Rich people get away with literal murder NOT because prosecutors, judges, and juries determine it is more beneficial for the public get their adorable autographs by setting them free rather than by putting them away.

Meanwhile, public defendents do their damndest to encourage their broke clients to cop a plea.
Plead guilty, next up: traffic stop for talking on a cell - now it's 6 months. Get caught with a nickel bag, now it's 20 yrs.

Michael Jackson or Steve Bannon don't show up for court dates, the judge encourages their big wig attorneys to try to get them to show up the next one that they'll also missed.

Hidalgo Rodriguez from Hunts Point don't show, his ass gets to sit in Rikers for the next 2 - 3 years awaiting trial. And no minus time served when he gets his ultimate sentence.

You can think what you want but you can't assume that avoiding incriminating yourself is evidence of guilt. Prosecution has to have evidence that supports whatever the charges are, and refusing to answer is not evidence.

You don't have to help the prosecution make their case. You might be guilty, you might not. It's incumbent on the Prosecutor to present the evidence against you. You have to understand that Prosecutors have a lot of latitude in the presentation of their case. You can be innocent, but the circumstances might make you look guilty. You can't be forced to testify against yourself. It's a Right guaranteed under the Constitution you have as a citizen of the country. As tempting as it might seem, you cannot draw a conclusion of guilt or innocence if someone pleads the fifth.

If someone pleads the fifth, the fact that they are using their Right to not self-incriminate is insufficient (for me) to judge their guilt of innocence. I can withhold judgement until more facts are in evidence. Apparently you can't even imagine being able to do that.

It’s also your right to do so when not guilty. Martha Stewart did nothing wrong involving stock trading, yet she spent three months in the pen because of something she said during an investigation. The investigators felt she misled them even though she did no underlying crime.
