This is another post born of ignorance regarding what charge was dropped, the lawful reason why it was dropped and why it never should’ve been a charge in the first place.

The prosecution flat out failed to do their homework, before and during the trial, regarding the dropped charge. If they cannot look at entirely objective evidence and interpret the law by his age and the length of the barrel, how can they possibly look at more complicated evidence and bring a charge of murder?

The judge failed his job. Charges will be brought back and no Double Jeopardy doesn't apply.

The law says it is illegal to carry a gun if you are under 16. Which part of the law do you not understand?

Here is an analogy to what happened. If you have to have a commercial drivers license AND be 18 years old to drive an 18 wheel truck, but you’re 17 years old driving a Chevy S 10 pick up truck, you can’t be charge for breaking the law.

The law your referencing bans "dangerous weapons" for minors. The following paragraph lists what is NOT a dangerous weapon and includes long barrel rifles. Your understanding is wrong.

The law is clear. He clearly broke the law by having a weapon under age 18. He clearly used it to break the law. The judge did commit judicial misconduct for dismissing a lawful criminal charge.

Because the following paragraph states that that law you reference (s.948.60) only applies to a person under the age of 18 who is in violation of s.941.28 or is not in violation of 29.304 and 29.593 (both hunting laws). Gotta read the whole thing.

The mother is clearly a stupid person

It is a misdemeanor for a minor to carry a "dangerous weapon". A "dangerous weapon" does not include a rifle over 16 inches in that state.

The law is clear, it only applies to short barreled rifles under 16 inches. It says so right in the law.

To call the judge's actions "biased" in Kyle's favor is a understatment.
