I knew a guy who was a world famous surgeon. He said that when he was Chief of Surgery at a major US University, he was sued for Malicious Mischief. A young surgeon came to his office requesting permission to give a young girl a strong anti-biotic which required the approval of his service chief. Side effects included deafness, etc. The child had an appendix that was many hours post-rupture and was close to death. Her parents were in the country illegally and put off bringing her to the E.R. for fear of deportation. He approved the drug. The girl survived the infection and surgery. But, she was deaf as a result of the antibiotic. The doctor was shielded from malpractice suits by the University. But, a lawyer sued him on behalf of the child and family for "Malicious Mischief." The girl was rendered deaf as an outcome of a decision he made. His personal lawyer recommended that he pay the family a large personal settlement. Which he did.
