I disagree — McConnell has already nuked the filibuster in areas that served Republican interests, like judicial appointments. Doing so while stonewalling Obama’s appointees means that Republicans earned themselves a massive advantage in the federal courts and the Supreme Court.
Worth noting as well that Democrats could reform the filibuster while stopping short of “nuking” it. For example lowering the threshold to 55 votes or creating their own carve-outs for particular issues like voting rights.
In the end, it is a Senate rule, not to be found anywhere in our Constitution, and runs counter to the practice of majority rule in every other democracy I know of.
If Republicans win a majority later down the road, so be it.
