It's not about whether it's OK to kill them; it's about WHEN it's OK to kill them: If they're Black, once they're 11 years old or more, and if they're White or nonblack, as soon as they sign up for the military.  Otherwise, we can only kill them if they kill someone else.  And even then, only if they're not White enough to afford lawyers to keep them off Death Row.
