Here's a quick primer on those two terms. The difference (a minor one), exists but it's just not germane to this case. The witnesses signed "under penalty of perjury."

The ability to counter-sue? Irrelevant. Trump isn't suing these women and never will, because any defamation claim against them would in effect become a rape trial for him (as proving the truth of the matter asserted is an absolute defense to libel). The last thing he wants. And he, a billionaire, doesn't need whatever paltry sums he could recover from them.

Tl;dr It's a big ol' red herring intended to get everyone thinking about procedural irrelevancies rather than the substance of what the two female witnesses here swore to.
