Self driving cars wouldn't choose because the situation wouldn't occur. A self driving car can only move as fast as it can calculate hazards, ergo the car would brake in time unless there was a malfunction, in which case it's still not choosing, just malfunctioning..

Now if the car did fail and kills one, who gets sued will be up for debate.. lots of variables to consider there (manufacturer build quality, owners lack of maintenance, driver override feature.. etc etc..)

Also, who tf came up with this scenario? "So yea basically who are we gonna make a car kill, a old woman crossing the road or a tiny baby all alone who somehow also is in the road.." For one, why would a baby be crossing the road, wouldn't the old lady pick it up or take it back to the other side or something? also, if I remember correctly, braking is a thing last time i checked and that car has more then enough room to break before it hits ANYTHING. I dunno, this shit doesn't make sense to me..

The scenario is if the brakes fail and the car HAS to pick one what should it do.

We can assume the child will die because the grandmother will hopefully have the time/strength to throw herself out of the way of the car.

Well yes. Lets say the brakes fail. We can see trees in the picture right? car has plenty of time to crash itself into a tree, again avoiding this dumbass scenario someone created out of thin air... I still cannot fathom who wrote this and why.
