Don't take it personal. I always find it funny when somebody who remixes other people's images gets bent about somebody stealing a meme.

Fair point though. Would be nice to be able to make a claim when somebody uses your idea. Thing is once it's released into the wild it's fair game. Our gifts to the World if you ask me.

FIRST, you have to REGISTER IT with the U.S. COPYRIGHT office. Since January 1, 1978 in the U.S. ANYTHING ANYONE creates is AUTOMATICALLY copyrighted. BUT to SUE you have to register it.

Yes, there's a fee.

THEN you'll have to PAY A LAWYER.

HOURLY ...

Copyright infringement is a VERY NARROW legal field. Very few lawyers do it. They'd probably charge about FOUR HUNDRED DOLLARS AN HOUR.

It has to be filed in FEDERAL court. Start to finish the case would probably be about TWO TO FOUR HUNDRED "BILLABLE" HOURS. So $400/hr x 400 hrs = $80-160,000 legal fees.

You could get "STATUTORY" damages of $25k minimum--SHOW AN INFRINGEMENT, GET A JUDGMENT FOR $25K + attorney fees. To get more you have to show ACTUAL DAMAGES, such as lost profits, etc.

Years ago I worked as a collection lawyer for Sears and for Hospital Corporation of America, the second-largest for-profit hospital chain in the U.S. So I know how the legal system ACTUALLY works.

People see so many personal injury lawyer ads "No fee unless we collect" that they don't realize that MOST legal work is NOT on a "contingent fee" basis. They also don't realize that THOSE lawyers "won't touch it with a ten-foot pole" unless there is INSURANCE available to pay.

Also, people don't realize that a court can't ORDER someone to pay a JUDGMENT. A judgment is just an indisputable OFFICIAL FINAL DETERMINATION of the parties' rights or obligations (even if that determination is FACTUALLY incorrect, e.g., Jones ACTUALLY ran the red light but BASED ON THE EVIDENCE AT TRIAL the court enters a judgment saying that Smith ran the light. Smith can't continue to argue that it was Jones.)
