Their point is that they advertise their encryption is unhackable. To allow anyone to access the information on that phone would leave doubt otherwise. This could have been handled differently by both sides but now it has turned into a marketer's dream for Apple.

128bit encryption used to be the standard for online banking etc... and thought to be un-crackable. Teenagers with the combined computing power of 6 playstations proved that wrong.
