Yeah. In 1939 he had a .45 for a year and a machine gun on his plane. The panel is from 1965 when he got the yellow circle around the bat symbol on his costume.
I spoke with editor Julie Schwartz about this issue at Pulp Con in the 90s. They caught heck over him using a gun in the story. But they too remembered the 39 version where he did.
