Actually, I'd forgotten about this case, even though at the time it really got me all riled up! Even the founders knew that for our experiment to work, the people could not be dumb asses, which is what anyone who does anything based off a meme is (well, perhaps is... I shouldn't generalize quite that much.)
And I think the reason I forgot about was that I knew it would have to be tossed on appeal. As ol' demented Autopen Bribe'm might say, come on, man! That's freedom of speech!
