In the US it depends, if it is an illegal alien you may, or may not get an appropriate sentence, the advantage in the US is the criminal courts are mostly run by the individual states, in most of the rest of the world the courts are run by the national government and are therefore more likely to be subject to the whims of the ruling national party.
