Or congress could make enough courts to handle them all in a month and then no one can complain.

That's my point. They entered illegally... no due process. They shouldn't get the same consideration when being deported.

Due process and fair trials are the mechanism by which the state decides guilt. If you, for example, are accused of being here illegally, your argument dictates you be deported, even if you are in reality here legally. If the state can punish without due process, that upends the foundation of the judicial system and violates the principle of innocent until proven guilty.

The right of “due process” is to protect citizens from their government, not to protect foreign trespassers from removal. Due process guarantees the rights of a criminal defendant facing prosecution, not an illegal alien facing deportation.

In this case, guilt would be being in the US illegally, no? By the principle of innocent until proven guilty, you assume that the accused is here legally, then you determine whether or not that is the case. The problem I have is not that illegal immigrants are entitled due process, but that the justice system dictates citizens are entitled due process, and innocent until proven guilty dictates that, when determining citizenship, you assume they have it (assuming innocence)
