Agree. Backing down is not cowardly when you have a much higher chance of severe repercussions than of success. Now that he's the elect he's nigh untouchable.
Still reading on how the dismissal without prejudice impacts the case but it looks like it stops the clock on the statute of limitations so the charges can be reinstated at a late date.
