Yes, but since we now openly operate under a two-tier leftist controlled 'justice' system . . . the legalities just don't matter any more. It's all about political expediency and the whims of the Political Left. How this came about is somewhat of a mystery since the actual Constitution itself and the Laws on the Books haven't changed.
