It states he had to engage in insurrection. How does one gauge whether someone has engaged in insurrection? By the Criminal History they have after being tried for Insurrection in a court of law.

He doesn't need to be criminally tried - the courts looked at the record of his actions and the events they led to and ruled they were disqualifying.

The problem with that second grade attempt at legal scholarship is those the 14th amendment originally disqualified from holding office were never tried for their insurrection.

Please point out his Criminal History where he was tried for engaging in Insurrection and where he was found guilty of just that. If you can't - your argument holds no water here.
