Disparate impact is not measured as an absolute but by the % of impact on groups identified by race, age or gender. Obviously a larger % of AA and Hispanics will be negatively impacted than Asian and White. That is a DISPARATE IMPACT and is legally considered racist.

Disparate Impact itself is racist and usually a farcical argument based on subjectivity and hypothetics. We are guaranteed EQUALITY. Not EQUITY.
