Where did you get that idea? The Federal government classifies marijuana as a Class 1 drug the same as heroin. The penalties are federal statues. That is why banks don't work with those making state legal marijuana money - the feds can take it.

Read the constitution. They can classify it however they want. They have no jurisdiction.
