I admit I was completely hypocritical about Roe. I was perfectly happy for SCOTUS to legislate from the bench because it was a right I supported. Now that Roe has been fixed, we will have to do it the right way. Some states have already added language to their state constitution to enshrine reproductive rights. That's the right way to protect rights, and that is our task now.

A right that disappears when you cross state lines or can be stripped away in the next election is not a right at all.

The only good thing that may come of Roe’s reversal is if women across the country rise up and deliver the Republican Party such an electoral defeat that they will beg for the days that Roe had remained in place and “pro-life” had remained a megachurch virtue signaling talking point.

Barring something like that, no, there is nothing to celebrate about Roe’s demise. What’s next? Return gay marriage to the states? Return contraception to the states? Return interracial marriage to the states? Return segregated schools to the states?

These were all rights established by “judicial fiat,” yet here we are with them. The country didn’t collapse after these rights were established — in fact, it got better.

Exactly. I was right there with you, enjoying the judicial abrogation of states rights for stuff I agree with. The constitution is super simple. Anything not explicitly given to the federal government is a state issue. Amendments are difficult. The right way is not usually the easy way.

But basic human rights shouldn't be in the states' say-so. If my job relocates me to the office in Nashville, do I become less human? If I were married to a same-sex, different-race partner, should I have fewer rights than my unmarried coworkers? Would our children be stripped from us at the state line?

Sounds like we agree that an amendment to the us constitution would be useful to protect rights from the whims of the courts. Maybe make human rights a new federal thing. Leaving it up to the courts leads to partisan heartache like this. Abortion and marriage weren't issues on the founding fathers radar, so it's up to us.
