Allegations are not proof. We've always upheld a standard in the U.S that you are innocent until proven guilty BEYOND reasonable doubt. Nothing they've ever tried to pin on Kavanaugh has ever come close to meeting that standard. If it did, he'd not be sitting on that bench today, but likely on one in prison.

It's the exact same thing with Kamala Harris; nothing levelled against her in the realm of sexual misconduct has EVER come close to breaching that standard.

He wasn't on trial: the same standard of proof is not relevant as it would be for either a criminal or a civil trial. He was applying for a job, and the question was, did he seem like a trustworthy candidate?

Oh come now, let's not get lost in the weeds of where he was. If there was any real evidence against him, it could have been brought forth in the form of a charge for sexual harassment or even rape. Judicial immunity for justices only applies for their actions while on the bench, so even now he could be sued.

The fact no such case has been brought forward is very telling.

Not so. Rape (and attempted rape) is a messed-up situation, that very often goes unreported, and even if reported, unprosecuted.

"According to the National Crime Victimization Survey, the average number of rapes and sexual assaults during 2002 and 2003 was 223,290 of which 81,310 crimes were rapes; 61,060 were attempted rapes, and 80,910 were sexual assaults. (Ibid.)

In 2003, weapons were present in rapes and sexual assaults 11 percent of the time. (Ibid.)

[MY NOTE: incredibly common: more than enough for 1 out of 10 women in the US EVERY YEAR. And not the armed stranger that we often imagine, either.]

An average of 140,990 completed rapes, 109,230 attempted rapes, and 152,680 completed and attempted sexual assaults were committed against persons age 12 or older in the United States between the years 1992 and 2000. A recently published eight-year study indicates that when perpetrators of completed rape are current or former husbands or boyfriends, the crimes go unreported to the police 77 percent of the time. When the perpetrators are friends or acquaintances, the rapes go unreported 61 percent of the time. When the perpetrators are strangers, the rapes go unreported 54 percent of the time."

By the very nature of the thing, there is rarely solid evidence of a crime that can be prosecuted. But if you're hiring a person for a job FOR LIFE, with immense power over all US citizens (more than half of them women) -- exactly what the Senate was doing there -- you want a candidate of unimpeachable character, not someone with serious bad stuff hanging over them who then pouts and growls at the process.

I would have agreed up until I saw the mud Amy Cony Barrett, whose entire life has been spotless, was dragged through as well. At that point I realized that any justice who is not an open progressive is going to be slammed with vicious attacks by detractors. My confidence in the ability of their opponents to be honest has been shattered.
